1. Introduction

Welcome to Zenith Real Estate Investments (hereinafter referred to as “Zenith”). These Terms and Conditions (the “Terms”) govern your use of the Zenith website and any services offered related to real estate transactions. 

2. Acceptance of Terms

By purchasing a property through Zenith, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree with these Terms, do not use Zenith.

3. Property Listings

Zenith provides information about real estate it owns and available for sale in Illinois to real estate investors. The information provided is for general informational purposes only.The property listings are subject to change without notice. Zenith does not guarantee the accuracy, completeness, or suitability of the information provided.

4. Use of Zenith

a. You must be at least 18 years of age to purchase properties from Zenith.

b. You agree to use Zenith only for lawful purposes and in compliance with all applicable local, state, and federal laws.

c. You are responsible for maintaining the confidentiality of your account, password, and payment information, and you agree to accept responsibility for all activities that occur under your account.

d. Your use of Zenith is also governed by our Privacy Policy, which can be found here.

5. Purchase of Property

Upon selection of a property to purchase, You may add the property to Your cart, and initiate the check out process. During check out, You will be prompted to complete an Offer for the property. The Offer will include:

  • Your name and/or the name of anyone else who will be on the title, such as a LLC, business partner or a spouse.
  • The address of the property and the amount of money being offered for the home, pre-populated from the property details page.
  • The amount of your earnest money deposit, in the amount of $5,000 per property.
  • Proof of funds, in the form of a bank or other account statement. The proof of funds must be sufficient to cover the entire purchase price for all homes added to Your cart.

After submitting the Offer, You will be directed to a payment screen where You must submit your earnest money. Payment may be made by credit card, wire transfer or ACH. We may cancel Your Offer if Your earnest money funds are not timely received.

After acceptance of Your Offer by Seller (“Acceptance”), it is Your responsibility to review the data for the property you wish to purchase on the property details page, estimate its value, order a title report and inspect the property & neighborhood. Note: all properties listed and sold on Zenith are sold in AS-IS condition. You may complete an inspection, but Seller will not negotiate repairs, offer any repair credits, or accept any inspection contingencies.

You will have seven (7) days following Offer acceptance to complete a home inspection. During this period, You may terminate your Offer for any reason and obtain a refund of your earnest money by submitting a written request to Seller at sales@zenithrealestateinvestments.com. Any earnest money paid by credit card will be refunded less processing fees. During this seven (7) day period, the property will not be listed on Zenith unless and until we receive your written confirmation that you are not moving forward with the purchase. 

Following the seven (7) day period described above, Seller’s attorney will prepare for closing by drafting a Contract for the sale of real estate. Prior to closing, You should consult with an attorney and carefully review the Contract with your attorney. 

You must have your own funds or financing in order to purchase the property. The Contract will not be contingent on obtaining financing. You will not have Your earnest money returned after the seven (7) day period if you cannot or choose not to close because of insufficient funds.

You acknowledge that Seller’s performance is dependent on Your performance of the responsibilities identified as being those of Yours herein and on timely decisions and approvals by You prior to closing.  You agree to comply in a commercially timely manner with all reasonable requests of Seller or Seller’s attorney for assistance to fulfill Seller’s obligations under the Contract. You agree that if any delays in closing beyond thirty days from Acceptance occur as a result of failure or untimely performance by or on behalf of You, Seller may cancel the Contract and you shall not be entitled to a refund of earnest money for any cancellation associated therewith.

REAL ESTATE AGENCY DISCLOSURE. You are hereby advised that Zenith represents the Seller exclusively. No contractual or agency relationship exists between the Buyer and Zenith.

6. Intellectual Property

a. All content on Zenith, including but not limited to text, images, logos, and software, is the property of or licensed to Zenith and is protected by copyright and other intellectual property laws.

b. You may not reproduce, distribute, or use any content from Zenith without our prior written permission.

7. Limitation of Liability

a. To the fullest extent permitted by Illinois law, Zenith disclaims all warranties, including but not limited to, the warranty of merchantability and fitness for a particular purpose.

b. Zenith Real Estate Investments LLC is not liable for any direct, indirect, incidental, special, or consequential damages resulting from any inability to use its website or purchase properties.

8. Jurisdiction and Governing Law

a. These Terms and Conditions are governed by the laws of the state of Illinois, without regard to its conflict of law principles.

b. Any disputes arising out of or related to these Terms and your use of Zenith shall be resolved in the state or federal courts located in Illinois.

9. Modifications

Zenith Real Estate Investments LLC reserves the right to modify, update, or change these Terms and Conditions at any time. It is your responsibility to check for updates.
